Requires health facilities licensed under IC 16-28-2 to obtain a national criminal history background check or expanded criminal history check for employees who will have direct contact with patients within 3 business days of employment start

Prohibits health facilities from employing individuals convicted of rape, criminal deviate conduct, exploitation of an endangered adult, failure to report abuse of an endangered adult, or theft (if conviction occurred within 10 years)

Prohibits individuals convicted of rape, criminal deviate conduct, exploitation of an endangered adult, failure to report abuse, or theft (within 10 years) from operating a health facility, with violation constituting a Class A misdemeanor

Allows health facilities to require job applicants to pay or reimburse the cost of background check fees

Grants civil and criminal immunity to persons who in good faith deny or terminate employment based on criminal history, or who report to or participate in proceedings of the state department of health or nurse aide registry
