SB 362 - Reuse of Single Use Medical Devices

• Defines "single use medical device" as a medical device intended for one-time use, as indicated on device labeling.

• Exempts reprocessed medical devices (those processed and manufactured under the federal Medical Device User Fee and Modernization Act of 2002) from the bill's restrictions.

• Makes reusing a single use medical device on a human patient subject to disciplinary action against a practitioner's license and constitutes a Class B infraction.

• Establishes that knowingly or intentionally reusing a single use medical device that results in serious bodily injury to a patient is unlawful reuse of a single use medical device, a Class D felony.

• Effective July 1, 2011.
