Senate Bill 373 Summary

• Requires governmental entities that receive criminal or juvenile restitution orders to file annual payment status reports with the court and state board of accounts, including information on arrearage amounts and compliance.

• Authorizes the state board of accounts to review restitution order status during audits of governmental entities that are beneficiaries of such orders.

• Grants the attorney general and prosecuting attorneys authority to bring collection actions on restitution orders more than one year in arrears, with ability to retain up to 10% of recovered amounts for litigation expenses.

• Empowers courts to take enforcement actions (show cause orders, contempt findings, or other judicial remedies) when payment status reports show non-compliance with restitution orders.

• Effective July 1, 2011.
