SB 0379 Summary

• Designates the lake and river enhancement fund for exclusive use in implementing lake and river enhancement projects required by law and for lake projects including sediment removal and control of exotic or invasive species.

• Establishes that unspent money in the fund at the end of a fiscal year remains available for subsequent years only for the specified purposes and does not revert to the state general fund.

• Prohibits the governor, state board of finance, budget agency, or any other state agency from transferring, assigning, expending, or removing money from the fund for purposes other than those specified in the statute.

• Blocks specific statutory mechanisms that would otherwise allow fund transfers by the state board of finance under IC 4-9.1-1-7 and by the budget agency under IC 4-12-1-12(e).

• Becomes effective upon passage and declares an emergency for the act.
