Senate Bill 397 Summary

• Allows nonresidents who own real property within a board of zoning appeals' jurisdictional area to serve as board members, in addition to resident requirements.

• Permits individuals who own real property in an unincorporated area to serve on an additional division of the board of zoning appeals established for that unincorporated area.

• Enables municipal plan commissions to designate either a resident or a property owner within the unincorporated area as their appointee to the municipal board of zoning appeals.

• Allows zoning ordinances to provide for appointment of one or more members of an additional zoning appeals division by elected officials of the county or township.

• Takes effect July 1, 2011.
