SB 399 Summary

• Prohibits starting construction of new confined feeding operations within two miles of state parks or reservoirs operated, maintained, or managed by the Indiana Department of Natural Resources after June 30, 2011.

• Prohibits applying manure within two miles of state recreational property boundaries after June 30, 2011.

• Exempts expansions of existing confined feeding operations and expansions of agricultural operations that become confined feeding operations from the construction setback restrictions.

• Defines "state recreational property" as state-owned parks or state/federally-owned reservoirs for which the Department of Natural Resources has operational, maintenance, or management responsibilities.

• Effective July 1, 2011.
