Senate Bill 413 Summary

• Establishes the Office of the Child Advocate within state government, consisting of one child advocate appointed by the governor for a term ending with the governor's term or reelection.

• Authorizes removal of the child advocate only for neglect of duty, misfeasance, malfeasance, or nonfeasance, with compensation set by the governor and approved by the budget agency.

• Requires the child advocate to take action to secure children's legal, civil, and special rights; review child protection policies and procedures; and refer complaints of child abuse or neglect to the Department of Child Services and law enforcement.

• Mandates the child advocate submit an annual report by July 1 to the governor and legislative services agency detailing activities, children's health and education status, and program implementation issues.

• Declares office records subject to public inspection except for confidential information pertaining to child care and treatment, including the identity of persons seeking assistance.

• Effective July 1, 2011.
