Senate Bill 421 Summary

• Requires condemnors to establish a proposed purchase price for religious organization property equal to the greater of appraised fair market value or appraised replacement value (including all buildings and improvements).

• Mandates condemnors provide religious organization property owners with copies of appraisals used to establish the proposed purchase price before exercising eminent domain.

• Requires condemnors to conduct good faith negotiations with religious organization property owners before proceeding with condemnation.

• Defines "religious organization" as an entity organized primarily for religious purposes and not for profit that operates under Section 501 of the Internal Revenue Code or has a Section 501 nonprofit parent organization.

• Effective July 1, 2011.
