Senate Bill 439 Summary

• Clarifies that IC 4-13-16.5 provisions are in addition to and do not replace IC 5-22-13 provisions concerning purchases from qualified agencies for persons with severe disabilities.

• Makes contracts or purchase orders void or voidable at a qualified agency's election if a purchasing agent fails to comply with section 3 requirements.

• Requires purchasing agents to notify contract awardees that non-compliance with section 3 may render the contract void or voidable.

• Adds requirement for the committee to provide written notice to the secretary of family and social services and director of the division of disability and rehabilitative services if governmental bodies violate provisions of this chapter.

• Declares an emergency, making the act effective upon passage.
