Senate Bill 505 Summary

• Declares that any federal act, order, law, rule, regulation, or statute found by the Indiana General Assembly to be inconsistent with the powers granted to the federal government in the U.S. Constitution is void in Indiana.

• Establishes that Indiana residents have a private right of action to enjoin the enforcement, implementation, or attempted enforcement or implementation of federal laws declared void under this bill.

• Awards reasonable attorney's fees and costs to plaintiffs who prevail in actions brought under this provision.

• Specifically finds that the federal Patient Protection and Affordable Care Act (P.L. 111-148) and the federal Health Care and Education Reconciliation Act of 2010 (P.L. 111-152) are inconsistent with constitutional powers granted to the federal government.

• Takes effect immediately upon passage.
