Senate Bill 511 Summary

• Requires electronic prescriptions to be transmitted only through board-approved electronic data intermediaries that prevent unauthorized access to prescription information.

• Prohibits electronic prescription devices from limiting medication choices, displaying multiple messages, or including advertisements and incentives that influence prescribing or pharmacy selection, except for formulary information meeting specific requirements.

• Mandates that persons maintaining electronic equipment receiving prescriptions ensure protection against unauthorized access and that pharmacies secure customer health information with confidentiality agreements.

• Establishes that electronically transmitted prescriptions meeting statutory requirements are considered original prescriptions and must include contact information for verification, date/time of transmission, and intended pharmacy name.

• Effective July 1, 2011, and amends IC 25-26-13 concerning pharmacy prescription handling and electronic transmission procedures.
