Senate Bill 513 Summary

• Enacts the Uniform Foreign Country Money Judgments Recognition Act, establishing a process for Indiana courts to recognize and enforce money judgments obtained in foreign countries.

• Applies to foreign country judgments that grant or deny recovery of money and are final and enforceable in the foreign country, excluding judgments for taxes, fines, penalties, and domestic relations matters.

• Requires courts to recognize foreign country judgments unless the foreign judicial system lacks impartial tribunals, or the foreign court lacked personal or subject matter jurisdiction over the defendant.

• Permits courts to refuse recognition if the judgment was obtained by fraud, conflicts with Indiana or U.S. public policy, contradicts another final judgment, or the proceeding violated due process requirements.

• Establishes that actions to recognize foreign country judgments must be commenced within 15 years of the judgment becoming effective in the foreign country, and allows such actions to be filed as original proceedings or raised as counterclaims in pending actions; effective July 1, 2011.
