SB 535 Summary

• Requires public agencies to allow inspection or copying of public records, or provide copies, within a reasonable time after receiving a request.

• Establishes civil penalties of up to $100 for first violations and up to $500 for additional violations against officers and management-level employees who intentionally violate open records or open meetings requirements; individuals are personally liable and penalties cannot be paid by their employers.

• Requires courts to conduct in camera inspection of unredacted public records when a complaint alleges denial of disclosure through redaction, except for attorney work product.

• Allows local government agencies with email capacity to provide meeting notices to non-media requesters via electronic mail or website posting; courts cannot void governmental actions for failure to use these methods if the agency made a good faith effort.

• Permits public agencies to withhold personal information about minors under 18 years old who participate in state educational institution activities, including contact information for the minor and their parents or guardians.
