HEA 1040 Summary

• Establishes "community fast responders" as volunteers performing CPR, defibrillation, or emergency services under direction of a nonprofit corporation, effective July 1, 2012.

• Applies Indiana's Good Samaritan statute (IC 34-30-12-1) and medical practice protections (IC 16-31-6) to community fast responders.

• Requires community fast responder nonprofit corporations to purchase insurance policies providing at least $700,000 in liability coverage for bodily injury or property damage caused by responders acting within their duties.

• Limits civil liability of individual community fast responders to insurance policy coverage and prohibits them from being named as defendants or liable for punitive damages for acts within their scope of duties.

• Caps civil liability of community fast responder nonprofit corporations at $5,000,000 per occurrence and exempts them from punitive damages; authorizes counties adopting ordinances approving these services to claim governmental immunity.
