HB 1042 Summary

• County auditor cannot endorse and recorder cannot record instruments that divide land and create new tax identification numbers unless the local plan commission provides written confirmation that the division complies with local regulations on minimum lot frontage, width, area, and subdivision and platting of land.

• Plan commission must execute the written confirmation, which must include any special conditions required for compliance and must be acknowledged by both the grantor and grantee.

• Plan commissions are prohibited from charging fees for issuing written confirmations.

• The written confirmation must be recorded as an attachment to the instrument dividing the land.

• Effective date: July 1, 2012.
