Prohibits smoking in public places, enclosed areas of workplaces, state vehicles used for governmental functions, and within 12 feet of public entrances to these locations

Exempts horse racing facilities, riverboat casinos, gambling facilities, satellite gaming facilities, cigar/hookah bars (21+ with liquor permits where 10% of income comes from tobacco sales), and retail tobacco stores (where 80% of income is from tobacco sales) from the smoking ban

Establishes enforcement through the Alcohol and Tobacco Commission, state and local health departments, and the Division of Fire and Building Safety, with authority to inspect premises for compliance

Creates penalties of Class B infraction for violations, escalating to Class A infraction after three prior violations; prohibits retaliation against employees who report violations

Requires establishments to post conspicuous signs indicating whether smoking is prohibited or permitted, and allows local governments to adopt more restrictive ordinances
