State Department of Health shall adopt rules establishing criteria for determining when an individual is dead, including by brain death, under IC 4-22-2.

State Department of Health must review evidence-based guidelines from medical organizations and Indiana's statewide medical association before adopting rules.

Anatomical gifts may only be recovered after a physician declares the prospective donor dead in accordance with accepted medical standards.

A physician's declaration of brain death satisfies the requirement for declaring a prospective donor dead.

Effective date: July 1, 2012.
