House Enrolled Act No. 1080 Summary

• Adds "sexual misconduct by a service provider with a detained child" (IC 35-44-1-5(c)) to the list of offenses requiring sex offender registration under Indiana law, effective July 1, 2012.

• Includes the same offense in the definition of "sex or violent offender" for registration and notification purposes.

• Creates a defense to promotion of human trafficking charges under IC 35-42-3.5-1(b)(2)(B) when both parties are minors or meet specific conditions including age proximity (not more than 4 years older), dating/personal relationship status, and absence of aggravating factors such as deadly force or drug facilitation.

• Expands the definition of sexual battery to include non-consensual touching of genitals, pubic area, buttocks, or female breast when the victim is unaware the touching is occurring, classifying it as a Class D felony (Class C if involving deadly force, deadly weapons, or drug facilitation).
