House Bill 1086 Summary

• Removes the requirement that the department of child services director must recommend or approve out-of-state placements for the department to pay costs.

• Makes the department responsible for out-of-state placement costs only if the juvenile court makes written findings based on clear and convincing evidence that: (1) no comparable facility with adequate services exists in Indiana, or (2) the facility is within 50 miles of the child's county of residence, or (3) the director recommends or approves the placement.

• Requires out-of-state placements to be less expensive than similar services available in Indiana for the department to cover costs.

• Effective July 1, 2012.
