HB 1105 Summary

• Prohibits employers from requiring employees to join or remain members of labor organizations, or pay dues, fees, or equivalent amounts to labor organizations as a condition of employment.

• Makes violations a Class A misdemeanor and voids any contracts that violate this requirement.

• Establishes private right of action allowing employees to sue for actual damages, civil penalties up to $1,000, attorney's fees, and injunctive relief.

• Exempts construction industry workers, federal employees, and workers subject to the federal Railway Labor Act from these requirements.

• Effective July 1, 2012, applying only to contracts entered into, modified, renewed, or extended after that date.
