Extends rights of publicity to deceased personalities who died before July 1, 1994, retroactively treating such rights as having existed from the date of death.

Prohibits use of a deceased personality's name, voice, signature, photograph, image, likeness, distinctive appearance, gestures, or mannerisms for commercial purposes for 100 years after death without written consent.

Excludes from publicity rights protection any personality whose commercial value derives solely from being formally charged with or convicted of a crime.

Maintains existing exemptions for uses in literary works, theatrical works, musical compositions, film, radio, television, newsworthy material, fine art, and news reporting or entertainment medium promotions.

Effective July 1, 2012.
