HB 1139 Summary

• Allows high school students attending non-member nonpublic schools to participate in athletics at public high schools within their legal settlement if they meet specified eligibility criteria.

• Students from accredited nonpublic schools must fulfill the same academic requirements as public school students and comply with all athletic association standards including codes of conduct, tryouts, physical exams, and transfer rules.

• Students from nonaccredited nonpublic schools must either meet accredited school requirements or have attended a nonaccredited school for the previous three school years and pass a nationally recognized assessment test approved by the department at minimum standards for their grade level.

• Students providing false information or documentation to meet eligibility requirements are ineligible to participate in interscholastic athletics and subject to association penalties.

• Public and accredited nonpublic schools that knowingly allow ineligible nonaccredited school students to participate are subject to penalties established by the athletic association.
