HB 1240 Summary

• Allows police officers and firefighters to appeal denials of payment requests for duty-related injuries or illnesses to their local pension board.

• Local pension boards must conduct hearings on appeals using the same procedures established for disability and impairment determinations under Indiana Code 36-8-8-12.7.

• Local pension board determinations on appeals are final and may be further appealed to court.

• Does not apply to or override contracts or agreements in effect on July 1, 2012, and does not preclude arbitration under existing contract provisions.

• Effective July 1, 2012.
