House Bill 1262 Summary

• Municipalities may adopt an ordinance to assume exclusive authority over storm water collection and disposal systems, including fee determination, construction, maintenance, planning, and regulations.

• Municipalities must provide advance notice to property owners subject to storm water fees and relevant drainage boards before voting on the ordinance.

• Municipalities assuming authority become liable for outstanding bonds and unpaid obligations of the previous authority and must continue payments until indebtedness is fully satisfied.

• The ceding political subdivision must transfer any unencumbered balances (reserves, collected fees, and accounts receivable) accrued before the ordinance's effective date to the municipality.

• County drainage boards must relinquish jurisdiction over ditches and drains located within municipalities that adopt such an ordinance, effective July 1, 2012.
