HB 1302 Summary

• Hospital clinical staff members and trainees must wear identification cards displaying their name, department, and job/trainee title, with trainees explicitly identified as such.

• Hospitals must provide written information to patients before admission (or within 24 hours for emergency admissions) explaining the role of clinical trainees, identifying the attending physician as responsible for care, and describing participation of medical students, interns, or residents in treatment decisions and surgery.

• Patients may request that a nurse call their attending physician regarding personal medical care, and nurses must place the call or provide the patient with contact information to call directly.

• Hospitals must establish a mechanism available at all times (telephone, pager, or other means) allowing patients to access prompt assistance for resolving personal medical care concerns.

• The state department of health administers and enforces these requirements; this chapter does not create a civil cause of action but does not preclude claims under common law or other law.
