SB 3 Summary

• Amends IC 35-34-1-5 to allow amendments adding habitual offender charges at any time before trial if the amendment does not prejudice the defendant's substantial rights.

• Eliminates the requirement that habitual offender charges must be filed within 10 days after the omnibus date.

• Removes the "good cause" showing requirement previously needed for filing habitual offender charges outside the 10-day deadline.

• Effective July 1, 2012.
