Senate Bill No. 9 Summary

• Allows the alcohol and tobacco commission to issue three-way permits for restaurants and new restaurants located in annexed territory within designated economic development areas without regard to quota restrictions.

• Requires restaurants to be located more than one mile outside the city or town's corporate boundaries as they existed before annexation and permits must be applied for within 12 years of annexation.

• Permits issued under this section cannot be transferred to another location.

• Cities and towns may designate annexed territory as economic development areas by adopting an ordinance defining the area's boundaries, with this designation applying only for permit purposes and not affecting other economic development designations.

• Effective July 1, 2012.
