Senate Bill No. 94 Summary

• Redefines public intoxication offense for alcohol use to require that the person endangers their own life or health, endangers another person's life or health, or breaches the peace.

• Makes it a Class B misdemeanor to be intoxicated in public due to controlled substance use, regardless of circumstances, unless the substance was consumed under a valid prescription.

• Applies the same endangerment or breach of peace requirements to intoxication in or upon public transportation, common carriers, depots, stations, airports, and similar facilities when caused by alcohol use.

• Requires controlled substance intoxication in public transportation and related facilities to be a Class B misdemeanor without exception, except for substances consumed under valid medical prescription.

• Effective date: July 1, 2012.
