Requires public schools, charter schools, schools receiving public scholarships, and state educational institutions to enter into written agreements with any individual or group performing the national anthem at public school-sponsored events, effective January 1, 2013.

Agreement must include standards and guidelines for the words and music of the national anthem established by the Department of Education in consultation with the Commission for Higher Education.

Performers who fail to comply with established standards must pay a $25 fine to the school or institution, deposited into the general fund.

Department of Education must adopt rules establishing procedures for recording performances, filing complaints, and adjudicating violations, with records maintained for two years.

State educational institutions must establish their own procedures for recording performances, processing complaints, and resolving disputes regarding national anthem performances.
