• Requires regional sewer district boards to be elected by voters rather than appointed, effective July 1, 2012.

• Allows districts established before July 1, 2012 to continue with appointed boards, but mandates amendment of those orders by January 1, 2013 to transition to elected boards.

• Elections must follow Indiana election law (IC 3) with the commissioner or designees serving as election officials, with board members elected from districts, wards, or at-large.

• Permits limited exceptions for governor or commissioner appointments in specific cases: multi-county districts, those including state property or correctional facilities, or those established before the effective date.

• Establishes procedures for transitioning existing appointed board members to an elected system.
