SB 130 Summary

• Consolidates three separate environmental boards (air pollution control, water pollution control, and solid waste management) into a single environmental rules board effective January 1, 2013.

• Establishes the environmental rules board with 16 members including 5 ex officio state officials and 11 appointed members representing constituencies such as agriculture, manufacturing, environmental interests, labor, local government, and small business.

• Requires appointed board members to possess knowledge, experience, or education qualifying them to represent their respective constituencies.

• Transfers all powers, duties, and rules of the abolished boards to the new consolidated board, with existing rules administered by appropriate department divisions (air, water, and solid waste).

• Modifies combined sewer overflow (CSO) permit requirements to require NPDES permit holders to review feasibility of additional or modified control measures when post-construction monitoring indicates performance criteria will not be met, rather than requiring periodic reviews every five years.
