SB 136 Summary

• Fire departments (paid or volunteer) may impose service charges on toll road project operators for fire and emergency protection services provided on those projects.

• Service charges must be reasonable, cannot exceed the state fire marshal's recommended schedule, and cannot duplicate charges already collected from other sources.

• Fire departments must provide written notice to the operator before initiating charges and when amounts change, and submit itemized bills within 30 days of service with a fire incident report if applicable.

• Revenue collected from service charges must be used for costs and salaries directly attributable to providing fire or emergency protection services.

• Fire departments may pursue civil action to recover unpaid service charges under this law, effective July 1, 2012.
