Senate Bill 195 - Summary

• Prohibits dollar limits, deductibles, copayments, or coinsurance for annual diagnostic mammograms that are less favorable than those applied to breast cancer screening mammography under state employee health plans, accident and sickness insurance policies, and health maintenance organization contracts.

• Defines "diagnostic mammogram" as a mammogram for individuals with a personal history of breast cancer or a breast abnormality suspicious for breast cancer requiring diagnostic evaluation, including physician interpretation.

• Exempts high deductible health plans from the coverage requirement if the federal Internal Revenue Service determines that annual diagnostic mammograms are not considered preventive care under 26 U.S.C. 223(c)(2).

• Requires the Department of State Personnel to request written guidance from the Internal Revenue Service by June 1, 2012 regarding the preventive care status of annual diagnostic mammograms under high deductible health plans.

• Effective July 1, 2012 for insurance policies, plans, and contracts issued, entered into, amended, or renewed after that date; Department guidance request effective upon passage.
