• Creates a Class D felony for operating a motor vehicle with an unrestrained child under 8 years of age if the vehicle is involved in an accident causing serious bodily injury to the child.

• Increases the offense to a Class C felony if the accident results in the death of the child.

• Creates a Class D felony for operating a motor vehicle with an unrestrained child ages 8-16 years of age if the vehicle is involved in an accident causing serious bodily injury to the child, with a Class C felony if death results.

• Provides a defense to prosecution if a physician, physician's assistant, or advanced practice nurse certifies that child restraint would be impractical due to physical or medical conditions.

• Effective July 1, 2012.
