SB 241 Summary

• Prohibits public works contract plans, specifications, and documents from requiring bidders, contractors, or subcontractors to enter into or comply with labor organization agreements on the same or related projects.

• Prevents discrimination against bidders, contractors, or subcontractors who refuse to enter into, remain signatory to, or comply with labor organization agreements.

• Prohibits requiring employees, as a condition of employment, to become members of labor organizations or pay dues/fees to labor organizations exceeding their share of collective bargaining, contract administration, or grievance adjustment costs.

• Creates a cause of action for interested parties (bidders, contractors, subcontractors, employees, and taxpayers) to challenge contract awards that violate these provisions, with prevailing parties entitled to attorney's fees and costs.

• Applies to contracts entered into, awarded, or renewed after June 30, 2012, and does not interfere with rights protected under the federal National Labor Relations Act.
