Senate Bill 278 Summary

• Eliminates emergency rulemaking authority for the office of the secretary of family and social services and the office of Medicaid policy and planning regarding federal Medicaid waiver programs and federal programs administered by these offices.

• Voids a final rule (405 IAC 1-11.5-2(g)) and emergency rules (LSA Documents #11-379(E) and #11-382(E)) that implemented reductions in Medicaid reimbursement rates.

• Restores Medicaid reimbursement rates by voiding the five percent reduction for chiropractic and podiatric services and the five percent reduction for speech therapists, audiologists, optometrists, opticians, independent laboratory providers, independent radiology providers, and freestanding renal dialysis clinics.

• Restores the Medicaid dispensing fee to $4.90 by voiding the reduction from $4.90 to $3.00.

• Effective immediately upon passage with the void provisions expiring December 31, 2012.
