Senate Bill 294 Summary

• Establishes Class C infraction penalties and personal liability for public agency officers and management-level employees who knowingly or intentionally violate the open door law by taking final action outside regular meetings, participating in secret ballots, discussing ineligible topics in executive sessions, or participating in prohibited series of meetings.

• Creates Class C infraction penalties and personal liability for public agency officers and management-level employees who intentionally deny requests for public records they know or should know are subject to disclosure under the open records act.

• Establishes Class C infraction penalties and personal liability for public agency officers and management-level employees who intentionally charge excessive copying fees.

• Prohibits public agencies from charging fees for electronic copies of public records transmitted by email, except for: reprogramming fees to separate disclosable from nondisclosable information, statutory or court-ordered certification or search fees, or fees for electronic maps.

• Effective July 1, 2012.
