SB 337 Summary

• Exempts family-owned legal entities (limited to parents or guardians of employed child) from most child labor law requirements, except for underage employment, school hour restrictions, and federal hazardous occupation rules.

• Allows non-parent adults at least 18 years old to accompany children under 16 at performing arts rehearsals and performances with parental permission.

• Establishes civil penalties for late-night/early-morning work hour violations (after 10 p.m. or before 6 a.m.) ranging from $50 to $1,000 and removes this violation category from hazardous occupation designations.

• Creates new tiered civil penalty structures for employment certificate violations ($50-$200), age violations ($500-$1,000), and hazardous occupation violations (up to $50,000 if child suffers serious injury or death).

• Directs the Department of Labor to distribute child labor law forms electronically or in print and deposits all civil penalties into the employment of youth fund for education and inspector hiring.

• Effective July 1, 2012.
