SB 340 Summary

• Establishes that "abortion clinic" means a freestanding entity performing surgical abortion procedures or providing abortion-inducing drugs, excluding hospitals, ambulatory surgical centers, and physician offices where these are not the primary service.

• Defines "abortion inducing drug" as medicine prescribed or dispensed with intent to terminate a clinically diagnosable pregnancy, including off-label drug use for this purpose, but excludes drugs prescribed for other medical indications.

• Requires abortion clinics to meet safety and health requirements including proper construction and maintenance for patient/employee safety, compliance with state fire prevention and building safety codes, and provision of a safe environment that minimizes infection risk.

• Mandates the state department of health inspect abortion clinics at least once per calendar year.

• Voids 410 IAC 26-17-2(f) effective January 1, 2013.
