Senate Bill 374 Summary

• Defines "transfer" as withdrawing from a school and enrolling in another public or nonpublic school, excluding general educational development programs, for purposes of calculating graduation rates.

• Modifies graduation rate calculations to use "the students' initial year" instead of grade 9 three years before the reporting year.

• Establishes that it is willful neglect of duty for teachers or certificated employees to counsel students to transfer to nonaccredited nonpublic schools in private residences without reasonable knowledge the family intends to conduct appropriate educational activities.

• Requires superintendents or their designees to review the curriculum of high school students transferring to nonaccredited nonpublic schools located in private residences and report students to the bureau of motor vehicles if instruction is not equivalent to public school standards.

• Repeals graduation requirements provisions that applied before July 1, 2010, making the bill effective July 1, 2012.
