Senate Bill No. 376 Summary

• Prohibits the parole board from making clemency recommendations for inmates sentenced to life without parole and requires forwarding such applications directly to the governor without recommendation.

• Prevents the parole board from conducting investigations or hearings for life without parole cases unless specifically requested by the governor.

• Mandates the Department of Correction release long-term inmates after 21-25 consecutive years of confinement (depending on earned credit time) if they have not lost good time credit in the prior six months and have obtained a high school diploma or GED.

• Repeals prior provisions requiring parole board hearings, discharge determinations, and rehabilitation assessments for long-term inmate release.

• Takes effect July 1, 2012.
