Senate Bill 415 Summary

• Creates new limited liability protections for public and accredited nonpublic schools that allow general public use of school facilities for physical fitness activities, effective July 1, 2012.

• Shields schools from liability for participant death or injury resulting from inherent risks of physical fitness activities, including negligent acts of participants like failing to follow instructions or obey warnings.

• Eliminates liability protections if schools have actual knowledge of dangerous conditions, fail to properly train supervising staff, or engage in willful, wanton, or intentional misconduct.

• Requires schools receiving monetary payment for fitness activities to post warning signs (1-inch letters) or obtain signed participant releases acknowledging the liability limitation.

• Requires written contracts for fitness activities to include the statutory warning notice in at least 14-point bold type to qualify for liability protections.
