HEA 1045 Summary

• Adds departments of aviation and airport authorities to the definition of "public agency" under Indiana Code 5-30-1-11, effective July 1, 2013

• Expands airport authority land use powers to include land use planning and zoning, with jurisdiction superior to other local government units on airport lands

• Extends maximum lease terms for airport land and facilities from 15 years to 40 years for general airport uses, and up to 99 years for permanent structures or under specific conditions with board ordinance approval

• Removes the restriction limiting airport authority spending on commercial intrastate air transportation facilities to a cumulative cap of $1,000,000

• Clarifies procedures for airport authorities established by the city of Gary to enter into long-term leases and management agreements for airport development and operation
