HB 1092 Summary

• Inspector general must notify complainants within 30 days of receiving a complaint whether further official action will be taken, including investigation, civil action, or referral to the attorney general or prosecuting attorney.

• If the inspector general intends to take further official action, the complainant must be notified of the results at the conclusion of that action.

• When declining to take further action or determining no enforcement action is justified after investigation, the inspector general must briefly explain the rationale, including lack of jurisdiction or absence of credible evidence, addressing each separate allegation in multi-allegation complaints.

• The inspector general may not disclose confidential information in required notices and may adopt rules to implement these requirements.

• Effective date: July 1, 2013.
