House Bill 1100 Summary

• Prohibits employee health benefit plans, insurers, and health maintenance organizations from requiring covered individuals or enrollees to use designated mail order or Internet-based pharmacies as a condition of coverage.

• Prevents plans and insurers from imposing different copayments, deductibles, cost-sharing, or prior authorization requirements on individuals using community retail pharmacies compared to designated pharmacies.

• Prohibits different quantity limits, refill restrictions, or duration limitations on prescriptions between community retail pharmacies and designated pharmacies.

• Prevents plans and insurers from imposing additional administrative requirements on community retail pharmacy users that are not required for designated pharmacy users.

• Requires insurers and health maintenance organizations to provide community retail pharmacies payment that is not less than payment to other pharmacies, including rebates and incentive payments, and prohibits using pharmacy dispensing practices to promote designated pharmacies.

• Effective July 1, 2013.
