HB 1101 Summary

• Extends grandparent visitation rights to great-grandparents under Indiana Code IC 31-17-5, allowing great-grandparents to seek visitation rights with great-grandchildren in the same circumstances as grandparents.

• Great-grandparents may petition for visitation if: (1) the child's parent is deceased, (2) the parents' marriage is dissolved, or (3) the child was born out of wedlock (subject to paternity establishment for paternal great-grandparents).

• Courts must determine visitation based on best interests of the child and may consider whether the great-grandparent has had or attempted meaningful contact with the child.

• Updates relocation notice provisions to include great-grandparent visitation orders alongside grandparent visitation orders when modifying custody arrangements due to relocation.

• Effective date: July 1, 2013.
