HB 1177 Summary

• Requires secondhand goods merchants to maintain detailed logs of each purchase including seller identity, property description, government-issued photo identification information, vehicle license number, and purchase price.

• Mandates merchants photograph both the seller and the secondhand property being purchased, and retain copies of government-issued identification and photos for two years.

• Requires merchants to hold purchased secondhand property separately and apart from other goods for at least 10 business days after purchase, during which the property cannot be sold or altered.

• Requires annual registration with the Secretary of State (fee of $100) and with local law enforcement agencies (fee of $50 per agency, or $50 total if multiple locations registered with same agency).

• Establishes violation of secondhand goods requirements as a Class B infraction, effective July 1, 2013.
