HB 1189 Summary

• Expands the definition of "person" under open burning laws (IC 13-17-9) to include individuals, partnerships, corporations, associations, trusts, estates, municipal corporations, school districts, counties, political subdivisions, state agencies, contractors, and other legal entities.

• Allows open burning of wood remnants from demolition of undesirable, predominantly wooden structures originally located in incorporated areas, provided the actual burning occurs in an unincorporated area.

• Exempts such open burning from requiring a permit or authorization from the Department of Environmental Management, local government units, or volunteer fire departments.

• Takes effect July 1, 2013.
