HB 1209 Summary

• Requires well owners or operators to submit an environmental compliance plan to the Department of Natural Resources and receive approval before beginning or expanding hydraulic fracturing operations after June 30, 2013.

• Environmental compliance plans must include well location and depth, base fluid volume and source, detailed descriptions and volumes of additives, maximum pressures, geological analysis, pre-drilling surveys, and pollution risk analysis for Indiana water and land.

• Allows owners or operators to withhold proprietary chemical formulas and trade secret information from submitted plans, but requires immediate disclosure to medical emergency professionals or the department if necessary for medical or first aid care.

• Department must review and approve plans within 60 days using data from the Indiana Geological Survey and considering compliance with the federal Safe Drinking Water Act, and must publish approved plans on its website.

• Department shall adopt permanent rules by July 1, 2013, and may adopt emergency rules effective through December 31, 2015, to implement the environmental review requirements.
