HB 1210 Summary

• Authorizes the Indiana Utility Regulatory Commission (IURC) to impose civil penalties of up to $5,000 on public utilities that violate utility laws or fail to comply with IURC rate or service requirements.

• Allows the IURC to impose an additional penalty of up to $10,000 if the violation demonstrates a willful disregard or willful failure to comply through a continuing pattern of conduct.

• Requires the IURC to consider the utility's size, violation gravity, good faith efforts, financial impact, and for nonprofits, effects on members when determining penalty amounts.

• Permits the IURC to independently pursue forfeiture or penalty recovery through the attorney general or, with governor and budget agency approval, through contracted outside counsel.

• Effective July 1, 2013.
